RENTAL AGREEMENT (MONTH TO MONTH)

TENANT IS REQUIRED TO PROVIDE THEIR OWN INSURANCE.

I TENANT HEREBY RENT FROM ZIP STORAGE COMPANY, AS LESSOR AND AGREE TO NOTIFYING 30 DAYS IN ADVANCE OF DEPARTURE OR WILL BE CHARGED ONE MONTH’S RENT.   THOSE CERTAIN PREMISES DESCRIBED AS  A STORAGE UNIT LOCATED AT 100 WILKINSON ST., SYRACUSE, NY 13204.  THEREIN AFTER REFERRED TO AS PREMISES.

  1. RENT, RENT EACH MONTH PAYABLE IN ADVANCE BY THE 1ST OF THE MONTH OR BY AUTO PAY DATE. In the event the rent is not received within 5 days after the due date or in the event of a dishonored check from Tenant to Lessor, Tenant agrees to pay $25.00 as liquidated damages for said late payment and $25.00 for liquidated damages for said dishonored bank check. UNIT MUST BE VACATED BY THE 1ST OF THE MONTH OR THE FULL MONTH’S RENT IS DUE.
  2. USE AND OCCUPANCY AND COMPLIANCE WITH THE LAW. The premises are to be used for storage of personal property and business goods owned by the Tenant of the type described above.  Tenant further agrees that the premises will not be used for purposes other than storage nor for human or animal occupancy.  Trash or other materials shall not be allowed in or near the leased premises. The trash containers on the premises are strictly for the use of the Lessor.  The storage or welding of flammable explosive or other inherently dangerous materials is prohibited.  Vehicles or other similar fuel driven equipment may be stored only if the fuel tanks are empty.  Lessee shall not store in the premises any item which shall be in violation of any order or requirement imposed by any Board of Health, Sanitary Department, Police Department or other governmental agency or in violation of any other legal requirement.  Tenant shall not sublet or assign all or any portion of the premises or Tenant’s interest without prior written consent of Lessor.
  3. CONDITION AND ALTERATION OF PREMISES. Tenant has examined the premises and hereby accepts them as being in good condition. Tenant agrees to immediately notify owner of any problems, defects or dangerous conditions.  Tenant agrees to keep the premises in good condition and to pay Lessor promptly for any repairs caused by the Tenant’s negligence or misuse.  Tenant shall make no alterations or improvements to the premises without prior written consent of the Lessor then all costs necessary to restore the premises to its prior condition shall be borne by Tenant.
  4. Tenant agrees that lessor or his agent may at any reasonable time enter to inspect the premises or make repairs.
  5. TERMINATIONS. This agreement may be terminated within 7 days written notice by either party. Tenant shall be liable for payment of rent for the full month and shall completely vacate the premises in good and clean condition, reasonable wear and tear accepted.  Any items left remaining in the storage unit will be the sole responsibility of the tenant to pay for removal.
  6. Tenant shall not abandon the premises at any time during the term of this agreement.  If Tenant shall abandon said premises or be dispossessed by process of law, or otherwise, than Lessor or his agent shall have the right to take immediate possession of and re-enter the premises.  Lessor and Tenant agree that in the event a notice to terminate the tenancy has been given by Lessor to Tenant and Tenant has not occupied the premises for any part of the 30 days covered by said notice of termination and any portion of the rent due for said period remains unpaid than the premises may be deemed abandoned by tenancy and Lessor may re-enter and take immediate possession of said premises, consider the tenancy terminated and relent said premises.  In the event notice to terminate has been given and in the event any portion of the rent for said 30 day period remain unpaid by the Tenant  to Lessor, and in the event any Tenant’s personal property remains on the premises, Tenant hereby grants to Lessor a security interest in said personal property and at the expiration of the said 30 days, Lessor may re-enter the premises, remove Tenant’s personal property and store it in a safe place, consider the tenancy terminated and re-let the premises.  Lessor may store Tenant’s personal property for a period of 30 days.  Upon taking possession of said personal property, Lessor shall mail to Tenant at last known address of Tenant, notice that Lessor has taken possession of premises and has taken possession of all Tenant’s personal property and has stored said personal property. It is presumed that any property left by Tenant does not exceed $100.00 in value.  At the expiration of said 30 days, Lessor may by public or private sale, dispose of the personal property upon 10 day’s notice of sale mailed to Tenant’s last known address.  There will be a $25.00 fee to remove the Tenants lock and replace with Lessors.
  7. ATTORNEY’S FEES. If legal action shall be brought by Lessor to recover possession, to recover any sums due under this agreement, or for the break of any other covenant or condition in this agreement, Tenant shall pay to Lessor all costs, expenses and reasonable attorney’s fees incurred by Lessor.
  8. Tenant shall hold Lessor and his agents harmless from all claims of loss or damage to property and of injury to or death of persons caused by the intentional acts or negligence of Tenant, his guest, licenses or invitees, or occurring on the premises rented for Tenant’s exclusive use. Tenant hereby expressly releases Lessor from any and all liability or loss or damage to Tenant’s property or effects arising out of water leakage, breaking pipes or theft or other cause beyond the reasonable control of Lessor.  Tenants possessions with the building are so place at Tenant’s sole risk and Lessor shall have no liability for any loss or damage caused to said possession whatsoever Tenant acknowledges that insurance is available from independent insurance companies for Damage to Tenant’s property and for the liability imposed in this paragraph and Lessor is not furnishing any insurance on content.

WAIVER AND RELEASE AGREEMENT

THIS IS A RELEASE OF LIABILITY AND A WAIVER OF CERTAIN RIGHTS

In consideration for receiving certain services from Zip Storage (“Company”), I agree to the following Waiver and Release:

I acknowledge that packing, loading, transporting and unloading and unloading property creates certain risks to my property and person.  In particular, property can be broken, dropped, scraped, torn, scratched, lost, etc., including risks to carpets and hardwood flooring, as well as risk of loss of cash, checks, bonds, jewelry, deeds, coin and stamp collections, alcohol, prescription medications, damage to fur or items lined with fur, particleboard furniture, firearms and/or ammunition and plasma televisions.  COMPANY STRONGLY RECOMMENDS THAT YOU PERSONALLY MOVE ITEMS OF SIGNIFICANT MONETARY OR PERSONAL WORTH.  Further, I could be physically injured by use of property damaged in the move, or through physical impact with furniture, boxes or vehicles.

I, for myself, my heirs, successors, executors and subrogates, hereby KNOWLINGLY AND INTENTIONALLY WAIVE AND RELEASE, INDEMNIFY AND HOLD HARMLESS COMPANY, its directors, officers, agents, employees and volunteers from and against any and all claims, actions, causes of action, liabilities, suits, expenses (including reasonable attorneys’ fees) for damages to my property or person resulting from COMPANY’S NEGLIGENCE during the move.  I further agree that Company is not responsible for the contents of any box it did not pack.  And, Company’s responsibility only extends to items while under its care and custody and terminates when it leaves the premises.
